ACCOUNT REPUDIATED
AN INTERESTING JUDGMENT. By Telegraph 1 .-ess Association WELLINGTON. December 5. An aeroplane propeller and aeroplane “dope” acquired by G. A. C. Cowper. flying instructor, in the name of the Whangarel Aero Club, was held by Mr W. F. Stilwell, S.M.. in a reserved judgment to be a liability against him alone in the case in which Gilbert Lodge and Co. sued Cowjjer and W. T. Surrnan, accountant, of Whangarel. as secretary of the Whangarel Aero Club, for £l6 4s 6d. Mr Stilwell reviewed the facts, which were that Cowper interested people at Whangarel in the formation of the Club and carried on with his own aeroplane, flying and teaching under an arrangement by which he acted as a free lance. The goods were forwarded to ar. order in the name of the club, but Surrnan repudiated the account. Mr Stilwell said that there was evidence of unbusinesslike methods but no evidence establishing the liability of Surrnan. Judgment was against Cowjx'r by default and for Surrnan.
