THEFT CHARGE

BROTHERS REMANDED FOR SENTENCE Charges of breaking and entering a garage at Ashburton and the theft of motor cycle parts valued at £B/15/-, the property of Robert White Smith Parsons, were preferred against two brothers, Robert Henry Meaclem and Laurence M r '.clem, in the Timaru Supreme Court yesterday afternoon before Mr Justice Kennedy. Mr W. D. Campbell (Crown solicitor) prosecuted, and Mr V. G. Russell (Ashburton) appeared for R. H. Meaclem and Mr A. D. Mcßae for L. Meaclem. The following jury was empanelled:—Arthur William Oborn (foreman), Henry Arnold, Thomas Grodie Malcolm son, John Downs, Arthur Harold Clemens, Edward Terence McLaughlan, John David Little, Edward Hall Robertson, Peter Coote, Michael Vernon Collins, Hector Henry Dodd and John Bernard Hamilton. Pleas of not guilty were entered. Mr Campbell explained that after the theft of motor cycle parts from a private garage in Ashburton, they were found at the residences of the accused, while Robert Henry Meaclem, it was alleged, sold a magnto belonging to the cycle to another man. Evidence for the Crown and the defence was then given, and counsel addressed the Court.

The jury returned a verdict of not guilty of breaking and entering, but guilty of theft. The jury submitted a strong recommendation to mercy on account of the youth ' both accused. The prisoners were remanded for sentence until 10 o’clock this morning.
