ANZAC DAY BREACHES
PENALTIES IMPOSED IN TEMUKA CASES. At the May sitting of the Magistrate’s Court in Temuka the Magistrate, Mr C. R. Orr-Walker, S.M., reserved judgment in the case in which the licensee of the Empire Hotel, Temuka, was charged with selling liquor on April 25, Anzac Day. Decision was reserved in order that consideration be given to the point raised by the licensee’s solicitor (Mr W. D. Campbell) as to whether or not Anzac Day and Sunday were required to be observed along similar lines in respect of hotel business. The Magistrate gave judgment in Timaru, in which he held that Anzac Day was required to be observed in all respects as a Sunday. At yesterday’s sitting of the Magistrate’s Court in Temuka, charges of being found unlawfully on the premises of the Empire Hotel on April 25 were preferred against George Watt, James Cecil Moore, Samuel Smith, Thomas Brophy, Thomas Waaka. Leslie Benbow and Michael McGillen. Smith, who had not previously appeared, appeared and pleaded guilty. To the Magistrate, defendant said that he was not a returned soldier. The Magistrate: “Not an Anzac." Arising from the above Matthew Michael Coffey was charged that, on Anril 25. being the licensee of the Empire Hotel he did sell liquor when the premises were required to be closed. The Magistrate said that he had already given a written decision in Timaru to the effect that Anzac Day to all intents and purposes, was required to be observed as a Sunday. With regard to the men found on. the premises, they would be fined £2 and costs each. The licensee’s action in dispensing liquor on Anzac Day was a serious ' Had it not been for several mitisrat ! pg circumstances he would have imposed the maximum fine of £lO. were some Anzacs in the defendants. and they had pleaded with the barman, and later with the licensee, to supply drink. The licensee would be fined £5.
