CASE WITHDRAWN.
ACTION FOR DAMAGES. By Telegraph—Press Association INVERCARGILL. August 20. A singular development occurred in the Supreme Court to-day, in a case in wffiich Margaret Mcßeath is suing ."or £1250 damages against Roy Rankin Wallace and Fleming and Coy., arising out of the death of her husband. the driver of a baker’s cart, as a result of a collision with a motor car. The case came on as a rehearing, on the ground that the verdict for £1250 at the previous session was against the weight of evidence. Several witnesses w r ere examined yesterday, and w’hen the Court resumed counsel for plaintiff said circumstances had arisen which counsel agreed rendered it a proper case to be withdrawn from the jury, and set down for trial later by consent of both parties. His Honour discharged the jury, and ordered a new trial next session, remarking: “Counsel have told me in the chambers the reason for the application. and there is no need to give that reason here.”
