An% important test, case involving in aggregate thousands' of pounds, came before Mr Justice Alpers in the Supremfa Court to-day. (The question interests all dairy farmers in Canterbury and all - the dairy factories. It deals with the pavment of bonuses for butterfat, and raises the point whether/; suppliers are entitled to bonuses as matter of right, or whether bonuses are gratuities given by. the 'dairy companies. Walter Frederick Kerr, of .Oxford, farmer, originally/.sned the Avon Dairy Company for £l4 9s 7d, a balance ho claimed was due to him for butter-fat, be had supplied d the Company. The sum by arrangement was increased to £25 6s l()d to enable the cake tg come before the Supreme Court:- ' Plaintiff was paid during the 1924-25 season Is 3|d for butter fat supplied to the faotory. Ho received no bonus at the end of the season, as in previous years. Other factories, he alleged, paid at the rate of Is 7,}d during that season. He claimed, therefore, that he should have received 3d per pound hongs at the end of the season, either as a bonus or as the balance of the purchase price due. The case was heard by Mr Justice Alpers, who reserved judgmont.
