TIMARU, JUNE 17. (Before Mr E. I). Mosley, S.M.) Judgment by default was given in each of the following cases: —J. C. Bradshaw (Mr Campbell) v. Nan Lynch, claim £7 7s, costs £1 11s 6d; C.E.C.A. v. G. J. Nelson, claim £4 10s, costs £1 3s 6d. JUDGMENT SUMMONSES. In a judgment summons case, Wimpenny Bros, and Reid (Mr IV. D. Campbell) proceeded against Francis B. \Vard (Mr O’Connell) for £52 19s (id. Defendant said he was a married man residing in Ashburton. His wages were £3 per week —with a free house. His wife’s health was bad, and at present she was practically gn invalid. Thus, he had to employ a housekeeper, to whom he paid 35s per week. According to medical advice, his wife would be incapable for some eight or nine months to conie. At present ho was not in a position to make any oiler. In reply to Mr Campbell, judgment debtor said the debt was for a promissory note on the purchase of a lorry. In addition to that debt, he did not owo a great degl, and had it not been for his wife’s ill-health, would have paid off the debt. No order was made. In another judgment summons case, Michael Twolull (Mr Knell, Waimate) took action ggainst J. C. McKeowen (Mr O’Connell) to recover £sl 10s. Judgment debtor, in reply to his solicitor, said lie was earning £4 per week, and since March his earnings were £sl. He was paying board at 30s per week. He was willing to pay off the debt ,at the rate of £1 per fortnight. In reply to His Worship, defendant said the judgment was for damages. Mr Knell said defendant was earning £4 per week, and apparently was in a position to m.ake a more substantial offer. . . , Defendant said it was impossible to increase his offer . Judgment debtor was ordered to pay the amount due; in default, one month’s imprisonment, warrant to be suspended so long as he paid 10s per week, the first payment to be made on June 19. Costs were allowed.
