FAIRBAIN LIBEL CASE.
AGAINST WAGO DAILY TIMES." VERDICT FOR £SSO. (Per Press Association.) CHRISTCTIUPXH. July 10. In the libel auction, thirteen issues were submitted to the jury. Mr McGregor urged that, the plaintiff was guilty of impropriety in going on tht' commission and brought the libel on himself, by delaying his explanation and answer to letters in the papers. Sir John Eindlny said the editor had admitted that he could not justify the charges in the leading article, but his counsel repeated the charges in the ea.se. The conduct of 4 the case .showed malice and bitterness and Sir John insisted that plaintiff was fighting the Merchants' Association, not the newspaper. Ho added that tins was an editorial result of party policies. Mr Justice Si in. summing tip said it was clear that the editorial article charged the Commission with dishonest suppression and the evidence showed that this was not true. The inclusion of Jamiesou's supplementary statement would have been 'improper. The presence of Mr Fa:rbairn on the commission was not improper ; even though be had been attacking the Merchants' Association. The verdict was unanimous for plaintiff 0:1 all points, with £B-50 damages.
