TIMARU—WEDNESDAY, NOV. 28th. 1906. .„ (Before MrC A. Wray, S.M.) CIVIL CASES. - Judgment by default was given, in the following cases:—J. B. Rutland v. James Young, Fairlie, claim £3l 15s 9d, on a promissory note, and costej £l 6s; F. M. Sbewan (Mr Shaw) v. -James Keene, claim 19s 3d, 'and.+ss„«Krtfl. " „.V- „ . J. T. Warren'(Mr Rayiojdfod} v. W. Lynch, claim £3 16s 6d, judgment stimmons. _ 1 Mr Raymond said that defendant contracted >a< debt with plaintiff for about £8 in January, 1905, and made some payments in reduction of the sum, hut. £3 16s 6d of the debt remained to be paid, and in October of this year an order was made by the court defendant to pay, the amount by weekly instalments of 10s. Defendant failed to comply with this order and since it was made he had paid other creditors who had had no judgment against-Mm. He was a farmer working 54 acres of land, and should be able to pay the'nmount. Defendant, said he was _nct_in regular work, and. was- working for his mother, but did not receive, regular .wages. He sometimes did contracting for. gorse cutting but did not attake much at that. He was not prepared to make any offer in reduction of the amount. His Worship thought that 1 ' defendant should pay the money and he made an order against him for the payment of £1 within a week, and ithe remainder to be paid off by instalments of- 1 5s per week; in default seven days' imprisonment. One case was struck out, neither party putting in an appearance.
