THE NATIVE GAME SEASON.
'Per Press Association. DUNEDIN, January 20. An important decision was given by Mr Cruickshank, S.M., at Kaitangata, in a case in which a, man was charged with killing native game out of season. Mr Finch, for the defendant, submitted that at present it was no offence to kill native game in New Zealand. In support of this contention he pointed out that at common law it was not an offence to kill native game and that section 17 of the Animals' Protection Act, 1880, which made it an offence to do so, had been repealed by section 5 of the Amending. Act of 1900 and had not been re-enacted as it ought to have been. • The Magistrate (Mr Cruickshank) upheld the contention and dismissed the information. This means that there is no protection for ducks, etc., at present.
