He told them to go away. He saw them go into the pantry and take a case of butter away. They returned again and asked for bread. He told the boatswain to give them some. He missed the butter m the morning, and searching for it found it floating m the harbour. To Mr Raymond : The men were the worse for liquor. Valued the butter 1 at about £2. Constable Whatman gave evidence of the arrest of the accused. At first they denied knowing anything about the butter. Later on they said they had been on the spree, and it might be overboard. Mr Raymond said that the affair was merely a spree, and as restitution was ma.ie it should meet the case. His Worship concurred, and ordered the value of the butter taken to be deducted from tiie wageH due to both accused. A.S.SAUI/r. Charles While was also charged with assaulting Edward Oarlston, the boatswain of the Ocean Ranger. i The cane arose out of the previous one. Complainant gave evidence that a quarrel arose and be was assaulted by the accused. ! The chief officer said that there was bad feeling between the two men, which might cause further mipchief. His Worship severely cautioned accused, and fined him 40s or seven days' imprisonment.
