PRIVY COUNCIL APPEAL.
CHRISTCHURCH, July 26. A private cable message was received by Mr. W. H. Wynn-Williams yesterday to the effect that the appeal by the Government to the Privy Council in the dispute between the Stamp Department and Mrs. Townend, relating to the payment of duties" in connection with the estate of the late G. H. Moore, has been dismissed. The question at issue was whether or not certain transfers of property made by Mr. Moore in 1.13 lifetime to hi« daughter, Mrs. Townend, were subject to deed of gift duty. The late Mr. Moore had during his lifetime handed over to Mrs. Tow'nend certain moneys and had transferred to her certain mortgages. The Government sought to impose deed of gift duty, but it was contended that the transactions were such as not to be subject to that duty. The matter was signed before the Court of Appeal in Wellington, and a majority of the judges, Mr. Justice Chapman dissenting, held that the transactions were not liable to deed of gift duty. The Government appealed to the Privy Council Hgainst tho decision, with the result that the appeal has been dismissed. The decision of the New Zealand tribunal therefore stands.
