A case involving ownership of property at North Shore, New South Wales, approximately valued at £2,000,000. lately came before Mr Justice Foster. The plaintiff, Francis Stephen Nichols, claimed that the property in question, comprising 940 acres of land now pretty well covered with buildings, was in 1805 granted to Isaac Nichol by Governor Gidley King, and descended by the law of entail to Joseph Nichol, by whom it was conveyed to the plaintiff. The case was practically a test one, and referred to 40 acres only of the 940 acres transferred. Mr Salomons, for the defendants, the Anglo-Australi in Investment Finance and Loan Company, set up a documentary and possessory title to the land, and sought to prove that tho action was an attempted fraud of v gross nature. In support of this he succeeded in extracting from John Joseph Nichols an admission that the whule of the property was disposed of for a cheque for £250 ; that tho cheque was drawn, not by the plaintiff, but by a Mr Campbell ; that ho had forgotten on what bank tho cheque was drawn, had never troubled about cashing it, and did not know what had become of it. Mr Salomans applied for a non suit, on the ground that the plaintiff's predecessor in title, being out of possession, had only power to convey the right of entry, and that this was illegal under the statute 32 of Henry VIII.
