B. MoKoy, otaim £7. 18s 6d. Judgment for plaintiff, and costs £3 4s'.— Same v. H. Sanders, claim £2 15s, costs £21056 d. FANNY OLEMOW T. H. BICHABDSON. Claim£Blos; Mr. 0. W. Govett for plaintiff, Mr. Standish for defendant. This was a claim for the value of a mare, which - was injured by the shaft of 'defendant's trap, colliding with it near the corner of St. Aabyn-street and' Queenstreet, on Maroh 23. The evidence showed that the plaintiff's mare was being driven by her brother on the proper side of the road when Richardson's horse shied, apparently at some object near the road and then ran into Clemow's mare. The animal was cut considerably. She was valued at £15. Defendant had made an offer to buy another mare to replace the injured one, but he had not done so. Counsel addressed the Bench on the' evidence. The Court ruled that as no negligence was shown on the part of the defendant judgment would be in his favor. The plaintiff was ordered to pay costs, amounting to £3 9s.
