CLAIM OF SINGER
SIR BENJAMIN FULLER SUED.
TERMINATION OF HER CONTRACT.

Miss Ruth Portrate, an operatic soprano, was awarded £5OO damages in her claim against Sir Benjamin Fuller in the Supreme Cour.t for a breach of contract arising out of the last grand opera season. Miss Portrat'e obtained a 22 weeks’ engagement at £2O a week but was dismissed after the first rehearsal of La Tosca. The defence was that, although there was no complaint about the quality of her voice, she lacked knowledge of La Tosca and thfit a clause in her contract enabled Sir Benjamin Fuller to terminate the engagement in the event of Miss Portrate not proving satisfactory. The question at issue was whether the dissatisfaction was genuine or capricious.
Sir Benjamin obtained a stay of proceedings for 21 days.
