WIDOW’S DAMAGES CLAIM
MANAGEMENT OF AN ESTATE. t REPORT MADE BY REFEREE. By Telegraph—Press Association. Wellington, Last Night. Twelve months ago Mrs. Alice Merry, widow of John Merry, bootmaker, claimed £2999 damages in the Supreme Court from the Public Trustee as administrator of her husband’s estate, alleging that grossly inadequate rents had been obtained in respect of three properties. After the case for the plaintiff had been opened it was agreed between the parties to make the question of rental value of properties the subject of inquiry before a special referee, Mr. E. Page, S.M. The referee’s report came before Mr. Justice MacGregor in the Supreme Court to-day, when counsel for Mrs. Merry moved for its adoption and judgment for £l3ll 13s 9d as damages alleged on the basis of the referee’s report to have been suffered by plaintiff "by reason of the defendant’s unskilful and negligent management and control of the properties.” This motion was opposed on behalf of the Public Trustee, who filed a substantial motion, and on this legal argument followed. The case will be continued tomorrow.
