STRIKE NOT UNLAWFUL
DOBSON MINE APPEAL UPHELD. ARBITRATION COURT DECISION. By Telegraph.—Press Association. Greymouth, Last Night. ■ The Arbitration Court to-day upheld the appeal of a Dobson miner, Brunneg, who with 133 others was convicted on August 18 by the magistrate,. Mr. Meldrum, on a charge of participating in an unlawful strike at the Wallsend mine. The miners said they objected to the tribute miners’ engagement. For the appellant counsel contended that the evidence did not disclose a strike. There was no discontinuance of work. Further, no agreement existed at the time. If the stoppage was a strike it was not unlawful in the circumstances of the case. Mr. Justice Fraser said a strike was disclosed but under section 4 of the Labour Disputes Investigation Act a strike had to refer to conditions of employment, but it did not in this instance, while section 9 required an agreement to be operating. The appeal was upheld as the strike was not unlawful.
