COMPANY DENIES LIABILITY. FATHER OF BOY GIVEN DAMAGES. By Telegraph.—Press Association. Auckland, Feb. 16. The first claim for compensation arising from a level crossing tragedy at Hikurangi on April 5 was heard by a jury to-day. John Frew, coal miner, claimed £750 from the Northern Motorbus Co., on account of the death of his son, aged 17. The defendants paid £l3O into court, but denied legal liability. The judge, Mr. Justice Herdman, directed the jury not to consider the claim in the light of punishment, but merely as a civil proceeding and take into account pecuniary loss only, not pain and suffering. The jury awarded £338 damages and costs.
