ETHICS AND THE LAW. London, July 39. The question “must a doctor tell?” was revived in a divorce court case, in which Dr. Hugh Bayly was questioned about the petitioner’s husband. Lord Merrivale, the Judge, emphatically pointed out that if a doctor were called upon to give evidence ho must comply or go to prison. Dr. Bayly declared that he had the patient’s written permission to give evidence, otherwise he would have refused. Lord Merrivale replied: “You must not misunderstand me. I have a duty-here. You also have a duty as a medical man and a citizen, but my duty predominates here.” The British Medical Association recently debated the question whether communications between doctor and patient ought to.be privileged in law courts.
