She left all her money to the four-year-old daughter, Patricia, on condition that she was taken from her father and reared by her uncle and aunt in England; but should the father decline to agree to this arrangement, then the child’s inheritance should be substantially reduced. The court held that the testatrix’s condition was opposed to public policy and was likely to deter the father from performing'his parental duty, which was sacred, just as were his rights. Therefore the gift to Patricia was absolute. Under this condition the child, 'will nherit the whole estate when 24 years’ Id, totalling about £20,000.
