LAND TAX CASE.
[United Press Association.] * Wellington, May 6. In the Supreme Court to-da-y the Chief Justice delivered Judgment in the action Henry Gainsford v the Commissioner of Taxes, a claim for the recovery of graduated land tax paid under protest. The Court that the < Assessment Act might require amendment to provide for the exemption of. life tenants where no income was earned. But the land tax was not based oil income, but on the occunancy of the land. Judgment was given for the Commissioner of Taxes.
