AMENDED PLAN

ACCEPTED BY VESTRY SEWER THROUGH CHURCH PROPERTY Writing to the Te Awamutu Borough Council, the Consulting Engineer, Mr R. P. _Worley, stated that he understood that the Church of England Vestry still objected even to the altered line of sewers through the church property. Continuing, Mr Worley stated the legal position is that if the Council by resolution disallows the objection, it can proceed to lay the sewer without committing trespass. There is no compensation payable for laying a sewer unless the property is permanently damaged thereby. In this case it is not conceivable that laying the sewer where proposed would damage the church piopeity in any way. I have sewered over a dozen boroughs and I have never heard such an objection upheld, nor has a single one of these boroughs had to pay one penny in compensations. However, only underground sewers may be laid in this way. . If a sewer is laid above the ground level the prior consent of the owner is necessary. Mr Worley enclosed a plan of an alternative route and said that the cost of laying the sewer on that route would be no more than the pegged route. If the owners prefer this alternative and give their consent in writing, I would recommend its adoption, concluded Mr Worley. The Clerk, Mr Palmer, stated that since the letter was written the Vestry had accepted the new proposal as outlined by Mr Worley and their objection had been abandoned.

On the motion of Crs Babbage and Williams the amended plan was approved.
