DECLARED INVALID
RABBIT BOARD’S RATES. DUE TO TECHNICAL MISTAKE. Rates levied by the Tuhikaramea Rabb't Board were declared invalid by an injunction granted in the Supreme Court at Hamilton by Mr Justice Blair. Applicant was John Henry Gore, and the board did not oppose the application. Mr Swarbrick, for the 'board, said the rate had been levied through a technical mistake and therefore no opposition was made to the motion, as the ratepayers really had the right to u'pset the rate. The judge remarked that a great number of small boards could not afford to secure legal advice and as a result sometimes made mistakes. The injunction implies that only the balance of rates owing, namely, £3O, need not be paid. The majority of ratepayers have already paid their rates and they are entitled to reimbursement without special legislation.
