We discharged him on March 8th. We allowed him to remain in the shop up to end of the month, having half the profits. We had a book-keeper, who received the monies. On Saturday last heard that the books were taken, and tuafc vlackie was spnposed to have them. Searched for the books, but could not find them. Saw defendant and asked him where the books were, or if he had taken them. He said lie had them, and that it was in consequence of something that appeared in tne paper. He refund to give up the books, and said lie wanted them to make up the accounts. The books are the property of Seddon and myself. The book debts amount to about £800 or £1000. We never re* fused to make up the accounts. Ci oss-examined : Defendant remaine I in the shop up to Saturday, receiving half the profits. Said he wished to make up the accounts, and would noi. give them up. Defendant demanded £250 from me before he would give me the books. Charge dismissed.
