APPEAL COURT.
QUESTION OF BY-LAWS. Press Association. WELLINGTON, July 14. The Full Court, consisting of the Chief Justice, Justices DennistOn, Edwards and Cooper, is engaged in hearing argument on four separate appeals against the decisions ef Mr T. A. B; Bailey, S.M., at Christchurch. The cases are:—MaeCarthy v. Madden;;. MacCarthy v. M'Donald; MaeCarthy ▼. Horwell, and MacCarthy v. Worthington.
The informations were laid against defendants for breaches of certain bylaws of the Borough of Riccarton. Madden and M'Donald were charged with'a breach of clause 110, Horwell clause 111, and Worthington clause 112. The clauses relate to the driving of stopje witliin the borough and limit the time v within which stock may be driven, and the number to be driven.
The Magistrate found that clause 110 was ultra vires and unreasonable, and that clauses 111 and 112 were unreasonable, and dismissed the informations. Argument is proceeding.
