SEQUEL TO ACCIDENT
NEGLIGENT DRIVING CHARGE MAGISTRATE RESERVES DECISION Decision was reserved by Mr. F. M. Levien, S.M.. in the Otahuhu Magistrate’s Court yesterday, when Dudley Richmond Anderson (Mr. Elliott) was charged with failing to give way to a motor-vehicle approaching on his right, at the intersection of Massey Road and Buckland Road, Mangere, on July 5.
The magistrate said he would visit the scene of the accident.
Joseph Thomas Hosking said that he was driving his car along Robertson Road toward Massey Road, Mangere. He estimated his speed at 25 miles an hour. When he reached the intersection of the two roads he slowed down to 15 miles an hour. Pie sounded the horn before he reached the corner. When he saw a car approaching it was on its correct side of the road. When he had nearly crossed the road, his car was severely struck by defendant’s car. The impact caused the car to capsize. Defendant’s car continued on for about a chain.
Mi's. Gladys Hosking, who was in the front seat of the car, said the car was travelling at a reasonable speed.
Anderson said he was driving a car owned by Mrs. Cook, who was a passenger in the car. When approaching the intersection of Buckland Road he sounded the horn, and looked toward Robertson Road. He estimated the speed of his car at 25 miles an hour. When he was crossing the intersection of the two roads a car came in front of him, and he jammed on his brakes. The next thing he knew, the other car caught the front of his car. Mrs. Dora Gertrude Cook, the owner of the oar, who was with Anderson, said the car was travelling toward Mangere Mountain at about 20 miles an' hour. She did not allow defendant to drive the car fast. She heard the horn sounded on her car, but heard no other warning.
