COUNCIL AND REMUERA PROJECT NICETIES IN BY-LAWS No reason for the non-provision in the City Council by-laws for the erection of flats in Remuera Was seen by a legal firm, which communicated with the council last evening. Anderson and Snedden, referring to the application on behalf of Messrs. Jones and Palmer to build flats in Victoria Avenue, Remuera, which was declined by the council In May, stated that they assumed that the council justified'its action In refusing the permit under by-law 191. This referred to buildings in the Remuera district. In their opinion, the by-law was unreasonable and unenforceable. Their client had given them instructions to take the necessary proceedings to test the position. They saw no reason why flats should be allowed in every other place but Remuera. The council was asked if it relied on the by-law, and If, In the event of proceedings, It would admit compliance by the client with the usual regulations. The acting-city engineer reported that no provision had been made in the by-laws for the erection of flats In Remuera. A stipulation was that no new house could be erected upon Remuera land unless there was a frontage of 50 feet and a mean average depth of 132 feet. In the instance in question, it was proposed to build flats with a frontage of 132 feet and a depth of 85 feet. The requirements of the by-laws could not be complied with if each suite of rooms were regarded as a separate house.
The council sent the question to the Town-Planning Committee.
