DRIVER’S EMPLOYER SUED

MAGISTRATE AWARDS DAMAGES Whether an employer is liable for damages in an accident due to his servant’s negligence was a question decided at the Magistrate’s Court yesterday by Mr. W. R. McKean, S.M. James Rigby claimed £SO damages against Henry Bray and Company, contractors, in respect of a recent collision at Northcote between plaintiff’s car and one of the defendant firm’s motor-trucks. Holding that negligence occurred while the driver of the truck was engaged in his employer’s business, the Magistrate allowed plaintiff £ 45 damages.
