Mcivean, S.M., in tire To lice Court when Edward Misted was charged with driving a motor car over the radway line at Maugere station on February 2d when the line was no 1 clear. , . Mr F. C, Gould, who appeared lor the Railway Department, said that a car driven by defendant ran into a train as it was slowing down ait the Mangere station. The three occupants of the car were all injured and had a narrow escape from death. The car was travelling slowly, and the train had whistled and was blowing oil steam. For the defendant it was stated that his car had been purchased only chrce days prior to- the accident, but it became a totall oss. Although! it was insured, he lost about £IUO on jt. * He himself was still under medical treatment and had been, dncliaiged from hospital only this week. He had a medical certificate stating that ho would not bo fit to appear tn court for a further three months, and even when he was out ol the doctor’s hands he would probably be partially paralysed. “His’attention must have been distracted by something,” remarked, the magistrate in ordering defendant oj pay the costs, £1 its. 1 J
