THE PEACOCK MURDER.
SENTENCE OF DEATH QUASHED BY HIGH COURT.
NEW TRIAL ORDERED

The High Court quashed the conviction of Dr. Peacock for the murder of Miss Davies. The Chief Justice found that although there was sufficient circumstantial evidence to show that Davies was dead, there was insufficient evidence to connect Peacock with the fact, there being no corroboration of the evidence of Poke, who was an accomplice. At Ibe trial the Judge should nave directed the jury that there was no corroboration of Poke’s evidence and that therefore it would be dangerous to convict. Had lie done so the jury must have returned a verdict of not guilty. Therefore a new trial should be granted. Mr Justice Barton agreed in quashing the conviction, but considered there should be a new trial. Justice O’Connor agreed there should be a new trial of Peacock.
The Court has ordered accordingly
