APPEAL COURT.

(Per Press Association) Wellington, October 4. In the Appeal Court to-day the case Schmidt and Bollshaw v. Greenwood is being taken. The appeal is from a judgment of Mr Justice Edwards, allowing respondents the sum of £lB7 10s as compensation for a deficiency in area of grassed land on the sale of a farm. The said farm, which contained 1022 acres, was held by appellants under occupation license, with right of purchase, and respondent, in January, 1910, purchased their interest therein. It was represented by appellants on such sale that the area of grassed land was 100 acres, but on a survey the actual area was found to be only 45 acres. For this deficiency his Honor gave compensation. Appellants claim that his Honor’s findings, both of fact and law are erroneous. Mr 8011, K.C., and Mr Quilliam appeared for appellants, and Mr Chapman, K.C., and Mr Spence for respondent.
