APPEAL COURT.
(Per Press Association.) Wellington, July 17. In the Appeal Court in the case Samson v. Aitcheson Mr Hanlon shortly addressed the Court, Mr Adams briefly replied, and the - Court reserved its decision. Wellington, July 17. The Appeal Court to-day commenced the hearing of the case Hummer and another v. the Shaw, Savill and Albion Co. The plaintiff was a passenger by the Tainui and was washed by a wave down a hold which had been temporarily opened and not protected. -The jury awarded Mrs Dummor £1250 and her husband £750 damages. Mr Stringer, K.C., and Air Dongall were for plaintiff's and Messrs E. and T. Harper for defendants. The question for the Court was whether the injury arose from negligence in navigation, from which the company was protected by conditions on the passenger ticket. Mr Stringer contended that keeping a hold open after the purpose for which it had been opened was completed comprised an act of negligence in the carriage of passengers for which the company was liable.
