Charles Dahl'claim ed from William Thompson the spocilh performance of a contract and £7AO 5damages. Air. E. 0. Jellicoe, with him Air. W. L. Fitzhcrbert, appeared for nlnin-tiff, and Afr. C. A. Loughnan and \\ E. Baldwin defended. The verdict wasx given for defendant with costs, on the ground that the title was not in order on the day set down for the cam pletion of the deal.
