MAGISTRATES COURT TUESDAY (Before Mr R. C. Abernethy, S.M.) Judgment was entered for the plaintiffs by default in the following civil claims:—Gordon McDonald v. Abater R. Murdoch (Taramoa) for £l, costs 12/-, R W Blair v. G. A McCauley (Lumsden), for £l/19/9, costs 8/-; F. D. Browning v. P. J. Bray (Dunedin), for £4/15/-, costs £l/16/6; Gore Publishing Company Ltd. v. Philip Uren (Gore,), for £l6/16/-, costs £2/14/-. No order was made in a judgment summons claim by Roderick McLeod against R. L. Beaton, of Gore, for the sum of £ll/15/1. Joseph Smyth, a labourer, of East Gore, was charged with failing to enrol in class A of the First Division of the National Reserve. Mr A. L. Dolamore appeared for the defendant, who entered a plea of guilty. j Sergeant S. King said that the defendant was 23 years of age and that he had not enrolled until June 24, 1941. When interviewed the defendant stated that he had been unaware of his obligations. The defendant had also not registered under the Social Security Act, and payments of levies had not been made, but this had now been fixed up. , , Mr Dolamore said that there had been no deliberate intention to avoid service. There were a large number of boys in the family, and six of them, including , the defendant, were living at home. That boys had all looked to their mother to obtain enrolment forms, and these had been obtained and filled in while the defendant was away from home. One of the forms had been spoiled and nothing had been done about filling one in when the defendant returned home. The defendant had become keen to serve when his brother had come home on leave, and, realizing that he could not have enrolled, he asked his mother to obtain another form. He had now been called up, and he was waiting word to go into camp. Another brother had left for camp this week. In addressing the defendant the Magistrate said that he was going to give him the benefit of the doubt on counsel’s statement that the defendant was quite prepared to serve. The defendant was convicted and fined £B, costs 11/-. A separation order was made by consent in an application by Mary Logue Mcßae, of Gore, against John Farquhar Mcßae, of Gore. A guardianship order in favour of the wife was made in respect of two children, and maintenance orders were made at the rate of £1 a week for the wife and 12/6 a week for each child. An order was also made for past maintenance totalling £2O. CHILDREN’S COURT Two youths were brought before the Children’s Court on a charge of unlawfully converting a car to their own use.
