NEGLIGENCE OF CAPTAIN

MARINE INQUIRY AT NAPIER FAILURE.TO KEEP PROPER LOOK-OUT (United Press Association) NAPIER, April 19. Negligence on the part of the master of the Koutunui, Captain A. McNab, was found by the Marine Court of Inquiry to have been the cause of the collision in the Napier roadstead on the night of January 31 between the Koutunui and the Miro.

The Court, comprising Mr J. Millar, S.M., Captain H. Worrall and Captain George Williamson, delivered its finding today. The Court held that the anchorage occupied by the master of the Miro, Captain M. Monaghan, was justified. It also held that the master of the Koutunui was negligent in failing to remember that he had passed the Miro on his way out to the roadstead. The Court held that the cause of the accident was that in view of the presence of the Miro, the master of the Koutunui was negligent in failing to keep a proper lookout—namely, an extra hand at the bow—and he himself failed to keep a proper lookout. To the question whether the collision was caused or contributed to by a wrongful act or default of the master of the Koutunui or the master of the Miro, the Court answered: “By the wrongful act and default of the master of the Koutunui.”

No order was made about the master’s certificate or costs.
