Kelly said that about 12.50 a.m. on January 26 Inspector Ireton and Constable Broomfield were patrolling the road to Oreti Beach when they saw a car being driven in a westerly direction at slightly more than 40 miles an hour. The car, which was swinging from one side of the road to the other, turned the corner at the Otatara store and swung on to the grass on the wrong side of the road. The inspector stopped the vehicle and found that it was a rental car that had been hired by Cyril James Clark and was being driven by Irons. Clark was in the back of the car. Both the inspector and constable were of the opinion that the car was being driven in a manner dangerous to other users of the road. The defendant, who pleaded guilty, said the rental car was not being driven at more than 40 miles an hour because the vehicle could not exceed that speed. The comer at the store was fairly sharp and he had to go over on his wrong side of the road to avoid some potholes. I The defendant was fined £2/10/-; | costs 12/-. I Cyril James Clark, hirer of the B rental car involved in the charge of s negligent driving, was charged with B permitting a rental vehicle to be driven K by another without a permit from the | licensee.
