MAN SENTENCED TO IMPRISONMENT
SELLING OF LIQUOR IN NO-LICENCE AREA
Frederick W. A. Boyes, of Gore, wais sentenced to six weeks’ imprisonment by Mr R. C. Abernethy,; S.M., in. the Magistrate’s Court at Gore yesterday for selling liquor in a no-licence area. The defendant was represented by Mr A. Smyth, who entered a plea of guilty. Sergeant J.. Abel said the defendant’s house had been kept under observation on Sunday, October 9. Several men visited the house that day and went away with liquor. During the morning two men bought liquor at the house and drank it in view of those attending a service at the Salvation Army Hall. Sergeant Abel said he was afraid he had nothing to say in favour of the defendant. In 1935 he had been convicted and fined £25 for carrying on the business of a brewer and on May 23, 1938, he had been fined £l2 for sly-grog selling. He was a man who would not work and was continually spending money in a billiard room. When the defendant was last in Court he had promised to give up selling liquor, but he had failed to do so. Sergeant Abel asked that the full penalty be imposed and that the defendant be imprisoned. Mr Smyth stated that the defendant was unfit for heavy work anct was on sustenance. He had a wife and four children, the eldest child being seven years old. There had been insufficient money to keep the home going and the defendant had said that was the reason he had continued to sell liquor.
“You have clearly set out to flout the Court,” said the Magistrate to the defendant. “You have received a warning and generous treatment in the past, and you cannot plead unfitness to work or family troubles if you continue to flout the Court and the law.”
