SCHOOL BUS LEAVES ROAD

CLAIM FOR DAMAGES OF £3161 (United Press Association) CHRISTCHURCH, November 1. Arising out of an accident on May 10 when a school bus swerved from the road near Hawarden and struck a tree, a claim for £3161 was made in the Supreme Court today against the driver and owner of the bus for injuries suffered by one of the girls riding in the bus. The plaintiffs were Elizabeth Mary Trumper, aged 10 years, the injured child, and her father, Angus Llewellyn Trumper. The defendants were Alexander Hugh Millar, of Hawarden, the driver of the bus and Ecroyd’s Garage and Transport Company, Ltd., owners and operators of the Hawarden consolidated school bus under contract with the Canterbury Education Board. The plaintiffs alleged in their statement of claim that a short distance past the intersection of the Pyramid Valley-Waikari road the bus ran off the left side of the road and mounted a bank, returned to the road, ran off the right side of the road, struck a fence and then struck a poplar tree. The child was stated to have been severely injured, receiving a heavy blow on the head, which gravely injured the brain so that she was unconscious for three weeks. The left side of the face and body had been paralysed and might be permanently so. She suffered a measure of mental incapacity and might suffer mental or physical incapacity permanently. Negligence was alleged on the part of the driver as the grounds for action. After hearing medical and other evidence for plaintiff the court adjourned until tomorrow.
