RAISING BAND FUNDS
SHOOTING COMPETITION. DECLARATION OF ILLEGALITY. (Per United Press Association.) Wellington. May 5. In a reserved judgment Mr E. Page, S.M., has decided to declare illegal schemes for the disposal of motor cars by a type of lottery which involves a shooting competition at a drawing. His decision is the result of a case concerning a scheme to raise funds to send the Port Nicholson Silver Band to Dunedin for the contests. W. J. Spittai and A. Buckley, representing the A Grade Band Contest Fund Committee, were the defendants. The Magistrate said skill was entailed in the shooting, but held that so far as the buyers of the tickets were concerned the matter was to be decided solely by chance and the scheme came within the statute. The Magistrate was asked to impose a substantial penalty and he fined Spittai £l5 and adjourned Buckley’s case for three weeks, his view being that there should be only one penalty, and if the matter was finished in that Court he would convict and discharge Buckley. ______
