ARREARS OF SALARY AND DAMAGES. (Per United Press Association.) Wellington, November 24. In reserved judgment the Magistrate, Mr Page, found in favour of Scott Gandy, Limited, defendants in an action in which Lawrence S. Gandy, salesman, employed by the firm from March, 1930, until February, 1932, claimed £ll5 3/2 for arrears of salary and expenses and £2OO damages for wrongful dismissal. In a cross action in connection with a car which Gandy failed to give back to the firm until a writ to recover it had been served, Mr Page awarded the firm £l5 damages and costs amounting to £4O 3/2 were awarded against Lawrence Gandy. After reviewing the whole of the circumstances in connection with the case Mr Page said plaintiff’s conduct showed he was unfit to hold his position and there was ample justification in the Magistrate’s view for his dismissal without notice.
