WINTON NOTES
MAGISTRATE’S COURT. (From Our Correspondent.) Judgment by default was given in the following cases:—Farry Bros. v. Mrs B. Gutsell for £2 15/-, Court costs 10/- and solicitor 15/6; J. E. Smith v. L. Findlay, Limehills, for £3 12/6, Court costs 13/-, solicitor 5/-; N. and U. Crosbie v. J. H. Kirkpatrick, Lumsden, for £33 0/3, Court costs £1 10/-, solicitor 11/6. Judgment Summons—The following orders were made on judgment summons: Nurse Brown v. John P. Flanagan, ordered to pay £7 9/6 on July 26, 1928, or in default 14 days in Invercargill gaol; J. N. West v. W. J. Butler, ordered to pay £4 4/on July 26, 1928, or in default 10 days in Invercargill gaol. Defended Cases—John Aitcheson, farmer, Kauana (Macalister Bros.) proceeded against Colin Gerard, millowner of Dipton (Russell Son and Meredith) to recover the sum of £ll7 the value of two wheat stacks, the property of plaintiff, which were destroyed by fire from sparks from the defendant’s traction engine while threshing plaintiff’s wheat. The plaintiff gave considerable evidence and the Court adjourned for lunch at 1 p.m. and on resuming at 2 p.m. Mr Russell for the defendant announced that a settlement had been reached between both parties and asked that the case be struck out.
The case was accordingly struck out, the Magistrate congratulating both parties on their amicable arrangements and very friendly spirit towards each other. Robina Thomson, of Limehills, proceeded against William Paynton, sawmill hanA also of Limehills, for £lOO on an. action of slander. Messrs Smith and Walsh for the plaintiff and Russell Son and Meredith for the defendant.
Evidence was given by the plaintiff and Rodger Reid, George Wilson and Alfred Bromley, all of Limehills, as to the slanderous words used. Mr Russell then addressed the Court on law points and asked that the plaintiff be non-suited, but the Magistrate decided that there must be judgment against the defendant, and after reviewing the evidence gave judgment for the plaintiff for £75, Court costs £1 17/-, witness’s expenses £3, and solicitor £4 15/-. ENTERTAINMENT. The Bluff Merrymakers journey to Winton on Tuesday night and gave a very bright entertainment in aid of the Winton Bowling Club. Unfortunately it was a rough night, which no doubt kept many from going who otherwise would have attended.
