RESERVED JUDGMENT

CLAIM AGAINST PUBLIC TRUSTEE. Mr G. Cruickshank yesterday delivered his reserved judgment in the case in which James Thomas Marshall (Mr Hall-Jonssl claimed to recover £232 from the Public Trustee (Mr Haggitt) as executor in and trustee of the will of Margaret Marshall (deceased). The plaintiff’s claim included £250, being the total amount of various sums paid by the plaintiff to his mother from time to time during the years 1895-1903, £7B for grazing 30 head of cattle, £3O 17s 9d moneys paid to Wright, Stephenson and Co., Ltd., and to Watson and Haggitt on behalf of his mother during the years 1907-11, and £44, being the total sum of cheques paid to his mother during her residence at Lumsden.

The plaintiff admitted as a set-off the sum of £l9O, being the amount of a promissory note given by plaintiff to his mother on April 1, 1915. The Magistrate said that he had looked into the case and was satisfied that the plaintiff had no claim against the Public Trustee except for the moneys paid to Wright, Stephenson and Co. and to Watson and Haggitt on behalf of his mother, for work done immediately before he had given the promissory note to his mother, and for the money paid, by cheque to his mother. Judgment would therefore be for £S9 7s 9d. No costs were allowed.
