MOTION FOR NEW TRIAL DISMISSED (Per United Press Association.) CHRISTCHURCH, November 18. Mr Justice Herdman dismissed a motion for a new trial in the case of Peter Dewar Boag (Christchurch) and Arthur Daniel Kennedy (Wellington) on charges of fraud made on both sides in respect to the sale of Mount Whitnoid, Canterbury, from defendant to plaintiff and the sale of Paerata, estate (Auckland) from plaintiff to defendant. The jury decided that defendant had been guilty of fraud, and that plaintiff had. not, and awarded plaintiff (Boag) £1535 10s damages. Defendant applied for a new trial on the grounds that the verdict was against the weight of evidence and th» damages were excessive. His Honour said the jury had not been guilty of any unreasonableness that would warrant his inter erence.
