The Blackball Trouble
ACTION AGAINST COMPANY FAILS. (Per United Press Association.) GREYMOUTH, April 30. The case in which Mr Fox, president of the Blackball Miners’ Union, sued the Blackball Coal Co. for £35 for wrongful dismissal, was concluded at Ah aura, to-day. A large number of witnesses were examined, the evidence being similar to that given at the Arbitration Court, when the Union was fined for striking. The following issues were submitted and answered by the jury : (1) Was plaintiff dismissed without notice. from defendant company on February 2G ?—Yes. (2) Was there any agreement in existence -whereby notice must be given before men are dismissed ?—No. (3) Whether any custon existed in this particular mine whereby miners were entitled to notice V—No, (4) What damages, if any?— Nil. The jury expressed the opinion that the mine manager should have showed more courtesy and allowed Fox to finish his shift. Costs wore allowed agalnst plaintiff for £32 0/G, including assessors and counsels’ fee.
