PROCEEDINGS. AGAINST A BANK

A test case, tho first of tho kind under the Shops and Offices Act came before Mr Eyre Kenny, S.M., to-day. The Inspector of Factories proceeded against Charles Tabuteau, manager of the local branch of the Bank of New South Wales under The Act for refusal of permission to inspect an extra time book. The defence was that no notice of intention to inspect had been given in l writing; that the Inspector had no right to enter the bank premisesunless there was a reasonable supposition that the provisions of the Act were being broken ; that general instructions received by the bank manager from headquarters would not permit the inspector to see the books and that the Shops Act did not apply to the bank as, by a separate Act of the New Zealand legislature, the bank was incorporated and hail power to make rules ;>f its own, fixing ’the time of attendance of its officers, no portion of the incorporation Act having been repealed. The magistrate reserved judgment.
AUCKLAND, May 5. Shopkeepers here have been notified that the Shops and Offices Act will be put into operation on Saturday, May 13th. The Inspector declines to give information re the exemptions, stating simply that the Act comes into operation' on the date mentioned.
