The Chief Justice delivered an important judgment in the ca.se q! Abraliaius an appeal against a conviction under tl\e Federal Cu9touis Act for- the ,presentation of certain false invoices. Tn6 chief grounds of appeal were that the matters alleged against defendant were not offences against Commonwealth law,- and any provisions of the Customs Act purporting to constitute the matters alleged against the defendant' olfencea were unconstitutional and of no effect. The Chief Justice upheld the contention that certain clauses of the Customs Act do not impose duties and that the clauses whereon the prosecution ; was founded were invalid. He quashed the conviction. The decision repeals the wholo of similar convictions obtained throughout the Commonwealth. The Government will submit the matter to the Full Court.
