TIMARU—THIS DAY. (Before J. Beswick, Esq. E.M. and E. G. Stericker, Esq.) CIVIL CASES. W. Gordon v. G. G. Russell, claim £22 2s 2d. Mr Hamersley for plaintiff, Mr C. Perry for defendant. Defendant had paid £l2 12s into Court, Judgment was given for plaintiff for £l4 is 4d, and costa £3 9s. Knud Sando v. J. Bruce, claim £7 2s 6d. Mr Forster for plaintiff. This was an action for recovery of commission, on the sale of thirty shares in the Royal Flouring Company. Mr D. M. Ross was called, to give evidence of the custom of the broking business. The plaintiff stated that he had been engaged to sell shares on a commission of 2£ per cent. In cross-examniation by defendant, he said he would solemnly swear that this was the agreement between himself and defendant. Mr Davidson also gave evidence of the custom in these matters. J. Ashwell, Secretary to the Linseed and the Dairy factories, at Tomuka, gave evidence that Mr Sando had been paid 2J per cent on the sale of shares in these companies. The defendant stated that he had agreed to give Mr Sando 2| per cent on all the money paid over to him (defendant) by plaintiff. Judgement was given for plaintiff for 30s and costs.
