ALLEGED ASSAULT.
At Marton Uonrt this (Thursday) morning, before Mr J. L. Stout, S.M., Walter Ernest Giver was charged with assaulting William Hinton and Selina Mary Hinton on 3rd January. Constable Manley prosecuted and Mr Lad ley appeared for defendant. After evidence had been given by the parties and Constable Manley, the Magistrate, in giving his decision, stated that there was some conflict as to who began the fight. There was no doubt that the woman was severely handled by defendant. She may have been helping her husband or trying to prevent an assault. Whether Giver went to the fight at the invitation of plaintiff to fight or not ho had no right to accept it if he could have avoided it. Giver should have produced hia witness at the time that the money was lent to Mrs Hinton. The injuries Mrs Hinton had received were more than what would have been received from a posh. In fotuie assault cases he would impose imprisonment without fines, as there were too many Coming into Court. In the case against Olver a tine of 10s would be imposed, and a fine of £3 with costs 5s in the second case.
