MAGISTRATE’S COURT

TRAFFIC OFFENCES T. Barker was charged at the Putaruru Magistrate’s Court, on Monday, that on February 11 he did operate a heavy motor vehicle at a speed exceeding 30 miles per hour. He was further charged with driving a motor vehicle loaded as to be liable tp cause- injury to any person. Traffic Inspector B M. Boyle stated that defendant had been travelling at 44 miles .per hour when he checked him. The truck was loaded with posts, some of which had moved during transport. On measuring the load he found the total width was 11 feet. Defendant, who did not appear at Court, was fined £2 and 12s costs for speeding, and £l and 12s costs on the second charge. Theft of Truck Wheel K. Taupawa, a young Maori of 21 years, was charged with stealing a Chevrolet truck wheel and tyre, valued at £25. Defendant pleaded guilty. • Constable R.. Dunn stated that wheels and tyres were frequently lost off trucks. They were placed on the back of trucks, and were often not securely fastened. A contractor, Mr. Rcbinson, who had recently lost a wheel and tyre had mentioned it to defendant. A day or so- later it was learned that defendant was selling a wheel andl tyre. Enquiries we-e made, and it was .found that defendant had picked up the wheel on the side of the road, and although he was aware that the contractor had lost one, hehad sold it. The Magistrate commented that the spare wheels should be securely fastened to trucks. He warned defendant that if he found anything: on the roads it was his duty to endeavour to return iit to its owner-. To sell it constituted theft. Defendant was placed on probation for a period of one year.
