Warden's Court.
[Before John Allen, Esq., B.M.] | . (CULLENSVTLLE, TUESDAY, APBIL 1.) Gus. Mattheson v. Charles Longhurst and Emily Longhurst. Claim to recover one-fourth interest in onefifth share in the Wairarapa claim, or l in the alternative £l5O damages. Mr McNab appeared for the plaintiff, and Mr Staite for the defendants. The main facts of the case were that over twelve months ago the plaintiff and defendant, C. Longhurst, made an exchange, Mattheson receiving a transfer of 500 scrip in the Karori reef, being one-fifteenth of 7,500 shares held by Longhurst, as an equivalent for the before-mentioned interest in the Wairarapa. The plaintiff coir-" tended that there was a failure of consideration because the Karori reef had not been turned into a registered company, and consequently there were no scrips in existence. The defence was that the defendants had acted all through bona fide, and that the interest the plaintiff received in the Karori reef was at the time of transfer fully equal in value to the interest in the Wairarapa claim.
After several witnesses had been examined His Worship reserved his decision, till Jhe next court day,_ the 15th instant.
Douglas v, the Wairarapa claim. This was an action to have the ownership of a terrace claim adjoining the Wairarapa claim decided. Mr McNab appeared for the Wairarapa Company, and Mr Douglas conducted his own case. .
After lengthy evidence had been taken His Worship announced that he would give his decision in Blenheim on Thursday, the 3rd instant.
