MANSLAUGHTER CHARGE

TRAM OUT OF CONTROL

DRIVER BEFORE COURT

(Ter Press Association.) DUNEDIN, this day

The trial commenced before Mr. Justice Kennedy in the Supreme Court this morning of 'Alfred Chapman, aged 53 years, the driver of a tram car that left the rails on the Opoho line on April 15 and careered across the footpath, killing John Kenny. Chapman is charged with manslaughter. The Crown Prosecutor staled that the Crown had merely to prove failure to exercise a reasonable degree of care. The evidence would show that the brakes and mechanism, were in perfect order with nothing to account for their supposed failure.
